Understanding Rent Increase Rules in Abu Dhabi

A rent increase in Abu Dhabi must be checked against the current rule for the property, not simply the amount advertised for similar homes.

A rent increase in Abu Dhabi must be checked against the current rule for the property, not simply the amount advertised for similar homes. ADREC's official announcement of 3 June 2026 temporarily changes the annual increase from five percent to zero percent until further notice. It also states that renewals and new agreements will reference the property's last registered Tawtheeq rental rate.

Read the temporary measure alongside the underlying law

ADREC's published local tenancy law contains an annual-increase mechanism and allows the percentage to be changed through the relevant decision. That is why an older summary stating “up to five percent” is not sufficient evidence that a landlord may presently apply that increase.

The June 2026 notice is a temporary measure, not a promise that the percentage will remain unchanged forever. At this review, the notice remains published. Before signing or contesting a demand, ask ADREC whether it continues in force, which transaction it covers and which registered amount is used as the reference. Keep the response and the notice date with the tenancy file.

Establish the property's jurisdiction

An ordinary local Tawtheeq tenancy and an ADGM tenancy need separate analysis. ADGM covers Al Maryah and Al Reem Islands. Its current AccessRP guidance describes a five percent residential increase limit and has a separate registration process.

Do not assume the ADREC announcement automatically rewrites every ADGM rule, or that an AccessRP FAQ settles an ordinary Tawtheeq case. If the property is within ADGM and the parties cite different measures, obtain current confirmation from the responsible authorities about the applicable instrument. The location, registration and timing should be included in the question.

Find the correct comparison amount

Request the current signed agreement and completed registration record. Where the temporary notice refers to the property's last registered Tawtheeq rate, an agent's advertised figure or an unregistered draft may not establish that reference. Ask for a clear explanation of any difference between the signed amount, registered amount and proposed amount.

Separate annual rent from utility charges, deposits and optional services. If a landlord says the rent is unchanged but adds a compulsory new payment, request its contractual and regulatory basis. A label alone does not resolve whether the amount is a distinct service charge or part of a disputed increase.

An index is information, not a private judgment

ADREC describes its residential rental index as providing indicative rental values and greater market transparency. An indication of the market is not the same as permission to disregard a current cap, notice requirement or temporary measure. A higher index value does not prove that the existing tenant owes the difference.

Use market information for planning alternatives and understanding the owner's proposal. Keep the legal question separate: which current rule authorises the requested amount for this particular transaction? The answer should identify the applicable provision rather than rely on the assertion that every neighbouring building is more expensive.

Check the proposal's timing and form

Under the published local framework, a party seeking changed conditions at residential expiry must give written notice two months beforehand. Specific facts and later measures still matter. A message received shortly before expiry should therefore be reviewed for both its amount and the process followed.

A discussion about future rent does not necessarily establish agreement. Respond clearly if a proposal is disputed, and avoid language that unintentionally accepts it while asking about payment arrangements. If the parties settle a different issue, record whether the rent question remains open.

Calculate the demand transparently

Prepare a simple comparison showing the previous registered annual rent, proposed annual rent and difference. For a hypothetical previous rent of AED 80,000 and a proposal of AED 84,000, the difference is AED 4,000, or five percent. That arithmetic does not make the increase lawful during a zero-percent measure.

If the payment schedule changes, compare it separately from the annual amount. More instalments may help cash flow without changing the rent, while fewer instalments may create a larger immediate burden. Keep the housing-budget comparison distinct from deciding whether an increase is permitted.

Raise a focused enquiry or dispute

Send the landlord a written request for the proposed amount's basis, the reference record and the relevant notice. State the exact point disputed rather than refusing every payment connected with the tenancy. Continue to address existing obligations and ask the proper authority how to proceed if rent is refused or the amount is contested.

ADREC's announcement directs people who believe the measure is not being observed to its official channels. A regulatory enquiry and a judicial claim have different purposes. ADJD's rental committees handle disputes within the local landlord and tenant framework, while ADGM has its own court route.

Verify again before the next renewal

Save the official announcement and any property-specific response, but revisit current guidance before a later transaction. Temporary measures can change. The official-source verification checklist helps distinguish an old statutory text, a newer decision and a current service instruction. The safest calculation begins with the correct rule and evidence, then applies the arithmetic.
