Employee Rights During a Probation Period in Abu Dhabi

For a worker covered by the federal private-sector framework, probation is limited and has specific notice provisions.

Probation does not mean an employee has no rights. Under the federal private-sector Labour Law, probation may last no longer than six months, cannot be imposed again by the same employer, and counts toward service if employment continues. Pay, safe working conditions and the correct work permission still matter from the beginning.

Notice during probation depends on who ends the relationship and what the employee intends to do next. The government guide to employment contracts explains these distinctions. ADGM has separate probation rules, so establish the applicable framework before using the federal notice periods.

Read the clause before the first day

Check whether probation is actually included in the employment contract, its length and the commencement date. An informal promise that the employer can keep extending it indefinitely should not be accepted as the legal position. Record the scheduled end date and ask how the employer confirms completion.

Understand the standards against which you will be assessed: responsibilities, reporting arrangements, training and any stated performance objectives. Request clarification if the work differs substantially from the offer. A short written summary after a review helps distinguish an agreed improvement plan from a later claim that expectations were obvious.

Keep the signed offer and contract, work-permit information, payslips and performance correspondence. Probation is an assessment period within an employment relationship, rather than a reason to work without documentation or receive unexplained deductions.

Federal notice depends on the situation

Where the employer terminates a federal private-sector employee during probation, at least 14 days' written notice is required. Where the employee intends to leave the job and the UAE, the employee must give at least 14 days' written notice.

An employee moving during probation to another employer within the UAE must give at least one month's written notice. The law also addresses compensation between employers for recruitment or contracting costs in that situation. Do not turn an employer-to-employer obligation into an assumed personal debt owed by the employee.

If someone resigns to leave the UAE but returns within three months on a new work permit, the law contains a further recruitment-cost provision involving the new employer. Tell the new employer the accurate history rather than attempting to hide the previous employment.

The consequence of failing to comply can include notice compensation or restrictions under the applicable rules. Obtain advice before walking out or signing an agreement that changes the required process. A manager saying no notice is necessary should be followed by a clear written release.

Salary and leave still need proper treatment

Ask when the first salary will be paid and how the employer records any partial payroll month. Recruitment, employment and visa costs should not simply be transferred to you because employment ends early. If a deduction is proposed, request its legal and contractual basis before agreeing to it.

Federal statutory paid sick leave starts after probation. During probation, the employer may grant unpaid sick leave supported by the required medical report. A more generous contractual benefit may apply. Notify illness promptly and do not assume the lack of statutory paid sick leave means certified absence needs no communication.

Annual-leave availability during the early employment period also requires the applicable rules and approval. Ask whether any leave is advanced and how it would be reconciled if employment ends. Read the annual-leave explanation rather than applying a full-year allowance to every newly joined employee.

Handle an unsuccessful review carefully

If the employer says probation has not been passed, request the decision, notice date, final workday and settlement statement. Clarify whether you must attend during notice, whether handover is required, and when work-permit and residence actions will occur.

For example, a verbal instruction to stop coming to work can create uncertainty about whether the employee was dismissed, placed on paid notice or recorded absent. Send a factual message confirming what was said and ask for written instructions. Avoid a confrontational assumption where a documented clarification can resolve the immediate risk.

Service length affects some termination benefits, but unpaid salary and other accrued rights should still be checked. Do not sign a statement that money was received if the payment has not actually arrived. Keep a personal copy of the settlement and any cancellation record.

ADGM is a different framework

The ADGM Employment Regulations 2024 apply from 1 April 2025. Official guidance permits probation of no more than six months and describes termination during probation on one week's notice or immediate termination for cause. It also identifies specific leave and pay treatment during probation.

The federal employer's 14-day notice must therefore not be presented as a universal Abu Dhabi minimum. Check the contract against ADGM's current employment guidance when the legal employer is an ADGM entity.

Plan the next lawful step

A new offer does not itself authorise work for a new employer. Coordinate the correct permit and residence arrangements before starting. An employment grievance also does not automatically extend immigration permission. Obtain the applicable deadline from the immigration record, keep cancellation evidence and use the correct authority for each process.

Government workers and domestic workers use separate employment laws. If the employer's identity or probation clause is unclear, resolve that question first. It determines which notice, leave and complaint rules can be relied on.
