Abu Dhabi Employment Regulations: Worker Rights, Labour Contracts, Leave and Workplace Obligations

Abu Dhabi employment rules depend on the legal employer and the applicable employment regime.

Employment rights in Abu Dhabi depend first on the legal framework covering the employer and employee. Most ordinary private-sector employment falls under the UAE federal Labour Law. ADGM operates an independent employment regime. Abu Dhabi local government, federal government and domestic-worker employment have separate legislation and procedures. Your office address alone does not determine which rules apply.

Once the framework is clear, review the contract, work permission, salary structure, hours, leave and termination arrangements together. These details affect everyday decisions as well as final settlement. An employee who understands which document governs each question can challenge an error with evidence and avoid relying on a colleague's unrelated circumstances.

Establish the employment framework

Begin with the legal employer's name on the contract and work permit. Check the licensing authority and whether you are employed directly, seconded or assigned through another company. A corporate group may have several entities operating under different regimes.

Employment situationStarting framework and authority

Most non-financial free zones use the federal framework alongside the relevant zone's regulations and administrative procedures. ADGM is a financial free zone with its own employment law. Its Employment Regulations 2024 took effect on 1 April 2025, replacing the 2019 regulations.

For Abu Dhabi local government, Law No. 8 of 2025 took effect on 1 January 2026. Older online summaries of the earlier government framework may therefore be incomplete. A government-owned commercial business is not necessarily the same as a government entity appointing civil servants. Ask HR to confirm the applicable framework in writing when uncertain.

Read the offer, contract and permit separately

The offer sets out proposed employment terms. The signed employment contract records the agreed relationship. The work permit authorises the relevant employment, while residence permission concerns lawful stay. Holding family-sponsored or long-term residence does not remove every work-permit requirement.

Compare the offer and contract before starting. Check the legal employer, role, commencement date, employment model, workplace, hours, basic salary, allowances, variable pay, leave, probation and notice. Query a change in terms before signing, particularly if a recruiter described benefits that do not appear in the final document.

Keep personal copies of the signed documents and subsequent amendments. If the employer manages everything through an internal portal, download the records you are entitled to retain before account access ends. Do not remove unrelated confidential company information. A concise personal employment file is useful without becoming a copy of the employer's business records.

Understand salary components and payment

Basic salary, allowances and total wage serve different purposes. A right calculated from basic salary may produce a different figure from one based on the full wage. Overtime, unused leave on termination and gratuity should not be calculated from a single unexplained net bank transfer.

Ask when salary is due, how a partial first month is handled and which approved payment system applies. Keep payslips and payment evidence. If there is a deduction, request the item, amount and legal or contractual basis. Recruitment and employer permit costs should not simply be shifted to the worker.

Variable benefits need their own reading. A commission scheme should explain when commission is earned and payable, and a bonus may have conditions that differ from fixed monthly salary. Ask for the written scheme before basing household commitments on an expected payment. For a disputed amount, provide the relevant period and calculation rather than only saying the total salary looks wrong.

Probation is regulated employment

Federal private-sector probation cannot exceed six months or be imposed repeatedly by the same employer. If employment continues, probation counts as part of service. Assessment during this period does not remove the employer's obligations concerning pay, safety and authorisation.

Notice differs by situation. An employer ending employment during federal probation must give at least 14 days' written notice. An employee resigning to leave the UAE also gives at least 14 days. An employee moving to another UAE employer during probation gives at least one month, with additional recruitment-cost rules involving the employers.

Those are not universal Abu Dhabi notice figures. ADGM has its own probation and notice provisions. Read the probation-rights explanation before agreeing a departure date or assuming an ordinary notice clause applies.

Working time, rest and overtime

The general federal private-sector working-time rule is eight hours daily or 48 weekly, subject to permitted variations and exemptions. Breaks, Ramadan hours, rest days and occupational safety also matter. Paying overtime is not permission to require unlimited additional work.

Eligible federal overtime generally attracts hourly remuneration based on basic salary plus at least 25 per cent. The specified night period uses a different uplift, with an exception for shift workers. Work on a contractual rest day requires separate treatment. Ask which category each claimed hour falls into and keep the authorisation and actual work record.

Do not infer an exemption from a job title alone. Actual duties and the applicable regulation matter. ADGM's official guidance treats hours, written consent and contractual overtime differently, so the federal percentage formula should not be copied into an ADGM calculation without checking. The overtime guide explains these distinctions.

Leave entitlements are separate categories

For a covered federal private-sector employee, annual leave is generally 30 paid days after one year of service. Where service exceeds six months but remains below a year, the statutory allowance is two days per month. Part-time calculations and more generous contractual terms need separate checking.

Post-probation federal sick leave can total up to 90 days in the service year: 15 at full pay, 30 at half pay and 45 unpaid. Notify the employer promptly and provide the required medical evidence. Work-related injuries and occupational diseases should not simply be charged to ordinary sick leave without checking their separate provisions.

Federal maternity leave is 60 days, with 45 at full pay and 15 at half pay. Additional medical circumstances can qualify for further leave, and nursing breaks follow their own rule. Paid parental leave is five working days for either parent within six months of birth, taken together or intermittently.

These figures deliberately identify the federal framework. ADGM uses different working-day allowances and conditions. Government employees and domestic workers use their own rules. Read the maternity-leave guidance and relevant leave article before making a detailed application or comparing benefits between jobs.

Conduct, equality and a safe workplace

Employees should carry out agreed duties diligently, follow lawful instructions, protect confidential information and observe safety procedures. Employers must meet the corresponding legal and contractual obligations. A workplace disagreement is easier to assess when the actual instruction, concern and response are documented.

The federal law prohibits discrimination on specified grounds, forced labour, sexual harassment, bullying and verbal, physical or psychological violence. A complaint should identify the conduct and evidence, rather than rely only on a label. Keep a factual chronology and use a safe reporting channel.

Immediate threats or violence may require police or medical help as well as employment reporting. An HR investigation is not a replacement for emergency protection. Obtain advice before collecting evidence through methods that could breach privacy or confidentiality laws. The workplace-protection guide explains practical reporting considerations.

Ending employment and checking settlement

Ordinary federal private-sector termination requires written notice generally between 30 and 90 days. Employment remains in effect during notice unless a lawful alternative is agreed. Probation and statutory termination without notice need their own analysis. Obtain the final date, work instructions and pay treatment in writing.

Request an itemised settlement for salary, notice where relevant, unused leave, gratuity or applicable savings benefits, contractual payments and deductions. Eligible foreign full-time employees under the standard federal gratuity scheme generally qualify after one year, subject to the law's conditions. Pension and approved alternative schemes can change the applicable treatment.

Federal final wages and other entitlements are generally payable within 14 days of contract termination. ADGM's official guidance describes a different 21-calendar-day rule for most final amounts, with separate treatment of variable payments. Do not sign an acknowledgement that money has been received when payment is still pending.

Disputes and immigration need coordinated action

MoHRE is the starting point for covered individual federal private-sector disputes. Current amended law permits ministry decisions on qualifying claims not exceeding AED 50,000. Challenges now go to the Court of First Instance, and a short 15-working-day challenge period can apply. The current court time bar is two years from employment termination, but that does not replace shorter procedural requirements.

Some official summaries retain older limitation or court wording. Check the amended law and current instructions rather than relying on a search-result extract. ADGM employees, government workers and other special categories should establish their own forum before filing. The authority-routing guide helps separate those routes.

Residence cancellation, dependant arrangements and any permitted period to remain in the country are separate immigration matters. A labour complaint does not automatically extend residence or authorise new employment. Obtain the relevant ICP record and deadline while pursuing employment rights.

For any significant change, keep a small timeline: decision received, employment end date, payment due, permit action and immigration deadline. Add the responsible authority and evidence for each entry. This turns a complicated departure or job change into specific tasks without confusing an employer's internal process with the official status of your employment or residence.
