Employer termination normally starts a sequence of separate decisions: the notice and final workday, final pay and benefits, work-permit cancellation, and immigration arrangements. Under the federal private-sector law, ordinary written notice is generally between 30 and 90 days, while final wages and other entitlements are due within 14 days of contract termination. Probation and lawful dismissal without notice have different rules.
Before accepting a settlement, establish which law governs the relationship. ADGM, government employment and domestic work require their own analysis. The federal termination guidance helps identify the relevant federal route.
Obtain the termination decision in writing
Ask for the notice date, stated reason, final employment date and instructions for work during notice. The last day physically attending the workplace may differ from the contractual termination date, especially where the employee is released from duties while remaining paid.
Do not treat a verbal request to stay home as a clear record of resignation or dismissal. Confirm the conversation factually and ask whether you remain available for work, who receives the handover and how pay will continue. Keep communication professional and preserve copies outside systems that may soon become inaccessible.
If the employer alleges serious misconduct, ask for the written decision and process followed. Federal dismissal without notice is confined to statutory circumstances and requires the applicable investigation and notification steps. The label immediate termination does not by itself establish that notice compensation is unavailable.
Check each settlement item separately
Request an itemised statement covering salary up to termination, notice compensation where relevant, unused leave, gratuity or applicable savings benefits, contractual payments and deductions. Identify which amounts use total wage and which use basic wage. One overall number does not show whether the calculation is correct.
An eligible foreign full-time federal private-sector employee generally qualifies for statutory gratuity after at least one year of continuous service. The standard scheme uses 21 days' basic wage for each of the first five years and 30 days for each additional year, subject to the statutory conditions and cap. Pension or approved alternative savings arrangements require separate checking.
Do not assume every payment called a bonus is guaranteed, or every contractual commission disappears at termination. Read the relevant terms, earned period and payment conditions. Ask payroll to explain a disputed item rather than accepting a blanket statement that all variable pay is forfeited.
Review unused leave and deductions
Unused statutory annual leave on federal termination is calculated on the relevant basic-wage basis, including entitlement for part of the year. Reconcile the employer's leave ledger with approved requests and prior balances. If the number falls sharply before departure, ask which transactions explain it.
For deductions, request the amount, reason and legal basis. Recruitment or visa costs should not simply be passed to the employee because employment ended. Property-return forms should identify actual equipment and condition; they should not be used to obtain an inaccurate acknowledgement that every financial entitlement has already been paid.
Sign only documents you understand and whose statements are accurate. Where payment is still pending, seek correction of wording that says it has been received. Retain the signed agreement, remittance evidence and any reserved disputed items.
Decide whether the reason needs challenge
Article 47 addresses unlawful termination connected with a serious MoHRE complaint or a valid lawsuit. Compensation is not automatically awarded whenever an employee considers dismissal unfair; the legal basis and evidence matter. The official guide describes compensation of up to three months' wage where that provision is established, alongside other entitlements.
Pregnancy, maternity leave, discrimination and workplace misconduct allegations can raise additional protections. Prepare a chronology showing the complaint or protected circumstance, employer communications and termination decision. Get advice promptly instead of assuming that a general redundancy label resolves every issue.
Manage residence and family records separately
An employment end date does not itself tell you the exact immigration grace period. Obtain the residence-cancellation record and ask ICP which deadline applies to your category. Dependant arrangements may require separate cancellation, transfer or other approved action.
A new job offer is not a work permit. Coordinate the new employer's authorisation before starting work, and retain evidence of the old permit's status. A labour complaint should not be assumed to extend residence automatically or perform the required cancellation steps.
For practical status planning, use the residency-rules overview alongside employment advice. Keep enough access to your phone, email and banking to receive official notices and final payments after leaving the organisation.
Follow the correct dispute route
For covered federal private-sector disputes, start with MoHRE. Current amended law allows MoHRE to decide qualifying claims not exceeding AED 50,000 and directs challenges to the Court of First Instance. The current court time bar is two years from employment termination, but shorter procedural deadlines can apply, so do not delay.
ADGM's 2024 framework has different notice and settlement rules; official guidance describes payment of most final amounts within 21 calendar days, with separate treatment of variable payments. Government employees use the relevant HR grievance route. Confirm the regime before calculating an alleged missed deadline or submitting a case.
