Maternity Leave Rights in Abu Dhabi

For workers covered by the federal private-sector framework, official maternity guidance provides 60 days of leave: 45 with full pay and 15 with half pay.

Under the UAE federal private-sector Labour Law, maternity leave is 60 days: the first 45 at full pay and the next 15 at half pay. A female employee may apply to begin it up to 30 days before the expected delivery date. Employees in ADGM and government roles must check their own employment framework rather than applying these figures automatically.

The UAE Government maternity-leave guidance explains the federal entitlement and additional medical circumstances. Begin with your contract, employer's legal identity and expected delivery date so the request uses the correct rules.

Plan the dates and payroll treatment

Notify HR early enough to arrange the application, medical evidence and work handover. Ask how the employer records the expected delivery date, the proposed start date and any change if the baby arrives earlier or later. Get written confirmation of the approved period and pay stages.

Federal maternity leave can apply during probation and does not require the twelve months of service used for ADGM maternity pay. The 60-day federal entitlement is expressed in days, not 60 working days. Check the employer's calendar calculation rather than mentally translating it into three months. If the contract offers more generous paid leave, ask whether that replaces or supplements particular statutory pay stages and obtain a clear schedule.

Create a household budget that distinguishes full-pay leave, half-pay leave and any separately approved unpaid absence. A payroll department may process the change in a different monthly payslip from the one expected. Ask for a breakdown when the payment and approved schedule do not match.

Additional leave depends on the circumstances

The federal guidance describes up to 45 additional unpaid days where qualifying illness of the mother or her child arising from pregnancy or childbirth prevents return to work, supported by the required medical certificate. These days may be continuous or intermittent. This is a medical provision, rather than an automatic extension available simply because a parent would prefer more time at home.

Where a sick child or a child with a disability requires a constant companion, the law provides a further 30 days at full pay after maternity leave, with a possible additional 30 unpaid days, subject to the medical evidence required by Article 30. Ask the treating provider and HR what documentation establishes the relevant condition and need for care.

The law also addresses childbirth at six months or more of pregnancy, including circumstances where the child is stillborn or dies. Sensitive situations should be handled through the exact legal provision and appropriate medical evidence. An employer should not assume that every pregnancy loss has identical leave treatment, or require a distressed employee to resolve the classification through informal workplace discussion.

Nursing breaks after return

For six months following delivery, the federal guidance provides one or two paid nursing breaks each day, with a combined duration of no more than one hour. The period is measured from delivery, not from the date the employee returns to work.

Agree how the breaks fit the working pattern and who records them. An employee returning after maternity leave has already used part of that six-month period. If the workplace uses flexible hours or remote days, ask how the breaks will operate without being deducted from annual leave or treated as an unpaid reduction.

A written return plan can identify the first working day, reporting manager, any medical restrictions and the agreed break arrangement. It is also useful to confirm continued access to systems and any necessary refresher briefing after a lengthy absence.

Article 30 prohibits termination or termination notice because of pregnancy, taking maternity leave or the qualifying absence associated with it. This does not turn every employment decision during pregnancy into the same legal issue. The reason, timing and documents matter.

Keep the leave application, medical records, performance correspondence and any termination communication. If the stated reason appears inconsistent with the surrounding facts, seek advice promptly from the relevant authority. Do not rely on a manager's assurance that resignation is necessary to process leave or residence paperwork.

ADGM uses different conditions

ADGM's Employment Regulations 2024 have applied since 1 April 2025. Official guidance describes 65 working days of maternity leave. Maternity pay requires at least 12 months' continuous employment before the expected or actual week of childbirth, together with the prescribed notifications and evidence. The first 33 working days are paid at full daily wage and the next 32 at half daily wage.

The ADGM guidance specifies written pregnancy notification at least eight weeks before the expected week of childbirth and notification at least 21 days before the proposed leave start. It also addresses adoption and specified pregnancy-loss circumstances. These conditions explain why an ADGM employee should use ADGM's current employment resources, not a federal private-sector leave calculator.

Abu Dhabi Government's Law No. 8 of 2025 took effect on 1 January 2026 and includes enhanced parental provisions. Government employees should obtain their entity's current HR rules; older summaries may describe a previous framework. Federal government service has its own HR legislation.

Maternity leave does not itself arrange the child's passport, residence permit or Emirates ID. Plan those tasks separately, along with insurance enrolment. The other parent's parental-leave entitlement is also a separate question. Coordinate both parents' approved dates around medical needs and documentation appointments.
